Pres. Rodrigo Duterte’s Speech on 69th Philippine Airforce Anniversary (page 2)



I’ll give you a reason very simple: Because it was not implemented and it was as if there was no death penalty provisions under the Revised Penal Code. It’s there. The law is not there anymore, because it’s like you have liquidated it already. But it could be reimplemented.


Bibigyan ko kayo ng napakasimpleng dahilan:  Dahil walang implementasyon at ito’y para bang walang probisyon ng parusang bitay sa ilalaim ng Revised Penal Code.  Nandiyan e.  Kaya wala na yung batas, mukhang itinumba mo na.  pero maaari itong maimplementang muli.


I will be here. I’m asking to revive death penalty and deterrence which they don’t tell. Retribution. Deterrence hoping that you’ll be discouraged to commit an error but once there’s perpetration, you pay and that is retribution. Pay your crime. Why should you - ? Now? Rape with homicide is released. They can always threaten the witnesses. But this is what I’m saying, both police. They commit crimes there in EDSA, kidnapping a person fearlessly, son of a…., as if a stroke of luck!


Dito ngayon ako, humihingi ako na ibalik ‘yung death penalty at pagpigil at kasi hindi nila sinasabi iyan e.  Pagganti.  Pagpigil sa pag-asang baka panghinaan kang magkasala pero pagka nagkamali ka, magbayad ka sa kasalanan mo.  Bakit ka mag -? Ngayon?  Nanggagahasa may kasamang pagpatay nakakalabas.  Palagi nilang nasisindak ang mga testigo.  Pero ito nga sinasabi ko, parehong pulis.  Gumagawa ng krimen diyan sa EDSA harap-harapan nag-kidnap ng tao, anak ka ng, para naman sinisuwerte talaga!


You are abusing the Philippines and I will not go for it. And they even the heinous, even the heinous crimes. If they commit it, they simply disappear. Inaabuso ninyo ang Pilipinas at hindi ko sasang-aayunan ito.  At sila kahit ang mga kasuklam-suklam na mga krimen.  Kapag ginagawa nila ito, nawawala lang yan sila.  Pagkatapos sasabihin nila “nag-AWOL na,” pero nandiyan lang siya.  Hindi siya inaaresto dahil siya ay police officer o dahil kabaro nila, ganun.  Kaya na-file yung kaso, pagtawag ng testigo, wala.  Kaya yung kaso matatabi muna, nakatambak.  Samantalang itong mga gago, nakikiramdam lang siya, kapag patay na ang testigo,o di kaya ang testigo ay lumipat na ng ibang lugar, kung ang testigo ay hindi na matagpuan dahil nabayaran na ng tagasilbi.  Gumagawa ako ng trial, nag-prosecutor ako ng sampung taon.  Babayaran lang ang tagasilbi tapos ilalagay “hindi na makikita o lumipat ng tirahan.”


Towards the end ‘he’s not aware that it’s already fixed, he appears suddenly before the judge. He will surrender: “Your honor, my client would like to - his realization about his…” Those melodramatic. “He’s now ready to face the consequences of the act - murder, kidnapping… okay?” He is… If non-bailable he’s sent to a penal institution somewhere. He’s just there. The next day, trial. Lawyer: “Your honor, we are ready. That is why we surrendered because we expect justice immediately. If we’re guilty, put him in jail already your honor, we’re ready for trial.” The server will appear, fiscal or prosecutor: “Ready?” “Your honor, I am sorry to inform the court that I have no witness at this time.” “Why?” “Your honor the service of the summon says he cannot be located.”


Kaya pagdating e ‘di malaman niya ‘yung ganun ayos na, lilitaw siyang bigla sa judge. Su-surrender iyan: “Kagalang-galang, gusto ng kliyente ko na – napag-isip-isip niya ang tunkgol sa kanyang…” ‘Yung mga dramang makabagbag. “Handa na niyang harapin ngayon ang resulta ng kanyang ginawa - pagpatay kidnapping… okay?” Siya ay… Kung walang piyansiya siya ay ipinapadala sa isang penal institution sa kung saan. Diyan lang ‘yan siya. Sa susunod na araw, trial. Abogado: “Kagalang-galang, handa na kami. Kaya kami ay sumuko dahil umaasa kami ng agarang hustisya. E, kung may kasalanan kami, ipakulong na kaagad kagalang-galang, handa kami sa pagdinig.” Dadating ang tagasilbi, piskalya o prosecutor: “Handa?” “Kagalang-galang, ako’y humihingi ng paumanhin na ipaalam ito sa korte na wala akong testigo sa oras na ito.”  Bakit? Kagalang-galang sinabi ng tagasilbi ng sumon na hindi siya matagpuan.”


No stupid fiscal in the Philippines who will go out of his office, to look for his witness. No stupid police can be asked “look for him.” I ordered for the arrest. In the meantime, I will say: “If my witness will not appear, I will move for his arrest.” And then I will ask the judge: “Wait judge because I’m still looking for my witness.”


Walang gagong piskal sa Pilipinas na lalabas ng opisina, para maghanap ng testigo niya. Walang gagong pulis, ma mauutusan mo na “hanapin mo ‘yan.” Inuutos ko ang pag-aresto. Samantala, ako, sasabihin ko: “Kung ang aking testigo ay hindi magpakita, tutungo ako sa pag-aaresto.” At kakausapin ko ang judge: “maghintay ka judge kasi hinahanap ko pa ‘yung testigo ko.”


But on the third postponement: “O, fiscal, ready?” “Your honor, I’m not ready your honor.” “Why?” “Same answer your honor.” They will invoke.


Pero sa pangatlong postponement:  O piskal, handa?”  “Kagalang-galang, hindi ako handa kagalang-galang.” “Bakit?” “Parehong sagot kagalang-galang.” Aapela sila.


“Your honor,” the defense says, “I move to dismiss the case because my client has been deprived of speedy trial which is granted under the Constitution.”


“Kagalang-galang,” sinabi ng depensa, “Isinusulong kong i-dismiss ang kaso dahil ipinagkait ang agarang hustisya sa aking kliyente na ipinagkakaloob ng konstitusyon.”

We just cannot do anything. And a dismissal because there are no witnesses or there is no witness is a dismissal with prejudice. Meaning to say, you cannot file the case anymore. What should I do? I was a fiscal before. I just can really bite my tongue. Now, think of me now, if you’ll do it again in the court, do it to me, do it to the country, what will happen to you? You should choose. You should choose. Do not deceive the country in my term because I will not tolerate it. That goes for all — criminality.


Wala tayong magagawa.  At ang dismissal dahil walang mga testigo o walang testigo ay isang dismissal na hindi patas.  Ibig sabihin, hindi ka na makakapag-file ng kaso.  Anong gagawin ko?  Noon piskal ako.  Kinakagat ko na lamang ang aking labi. Why not flaunt it. Why should you… Why do you -?


Hanggang ngayon ‘di pa makuha sa… Nandito ‘yung ating Director General. ‘Yung kidnapping, ‘yung mga carnapping. Ito si Evangelista, ‘yung masigasig nasa VACC ngayon. Ito ‘yung tatay na nag-drive doon sa casa ng kotse, may-ari ang anak niya. Diretso-diretso na kinarnap, sinunog pa ‘yung katawan. Bakit mo ba gaganunin? Kung patayin mo na ‘yung tao, bakit mo susunugin? E kung ilantad mo lang diyan. Bakit mo… Bakit mo - ?


These Chinese communities, time and again. Perhaps about 42, 43, I do not know. But I’m sure over 40. Kidnap, child, son, pays ransom, cannot be located anymore. Demands money continuously. ‘Without knowing that the victim was already lifeless. I’ll tell you the truth in Davao: All of the kidnapped there are dead. I’m not… I’m not threatening you. You go and check the records. All of the kidnap victims are dead. I’m not afraid. I’m not addressing myself to the human rights. What’ll I get? I said I’m ready to go down. I’m ready to stake my honor and even my life. Stop!


Itong mga komunidad ng mga Intsik, pauli-ulit.  Malamang humigit-kumulang 42, 43, hindi ko alam.Pero sigurado akong mahigit 40.  Kidnap, anak, bata, magbabayad  ng ransom, wala na. Sige pa rin hingi-hingi. ‘Yun pala, wala na talaga. Sa Davao sasabihin ko sa inyo ang totoo: Lahat ng na-kidnap doon, patay. Hindi ako… Hindi ko kayo tinatakot. Pumunta kayo at tingnan ninyo ang rekord. Lahat ng na-kidnap sa Davao, patay. Hindi ako natatakot. Hindi ko ito ipinamumukha sa  human rights. Anong makukuha ko? Kagaya ng sabi ko handa akong bumaba. Handa kong isugal ang aking karangaln at maging ang aking bahay. Tigil!


Then we have the corruption in government. Again it has to stop. Decades of corruption. People have nowhere to go to. Even when I was a fiscal, I want to go to the postal office to get my things there and even my mother, someone sends the… will really pay. Stop! You' place yourself in jeopardy of going to prison.


Tapos may korapsiyon tayo sa gobyerno.  Inuulit ko, kailangang matigil ito.  Dekada ng korapsiyon.  Wala na talagang mapuntahan ang tao. Maski ako ‘nong fiscal ako, gusto kong pumunta sa postal office para sa kukuhaning bagay dun at kahit ang aking ina, may ipinapadala ‘yung… mag—bayad talaga. Tigil! Inilalagay ninyo ang inyong sarili sa panganib na makulong.


All of these fixers, stop! I hope Faeldon would do his thing. Stop corruption in Customs. And Billy Dulay, I know him. He’s very good, he’s honest, I hope he can deliver. I don’t mind if it will be a lesser income for [unclear] I am prepared for that, but do not… You in the BIR [Bureau of Internal Revenue], stop because I will make a trail out of you. All is being monitored now. And I will use technical, if you understand what is technical. I will listen to you. That’s the only way to fight corruption. That’s also illegal. Of course, it is illegal, only when I present the evidence in court. But if I will not present evidence in the court, I will not put you in jail, I will kill you, that’s fair. That one is difficult.


Lahat ‘yang mga fixer fixer, tigil! Umaasa ako kay Faeldon na gagawin ang tungkulin niya. Itigil ang korapsiyon sa Customs. At si Billy Dulay, kilala ko siya. Napakabuti niya, mapagkakatiwalaan, umaasa akong may magagawa siya. Hindi ko iniintindi kung ito man ay mababang kita para [hindi maliwanag] Ako’y handa para diyan, pero huwag… Kayong mga BIR, tigil dahil ako’y gagawa ng taga-monitor magmula sa inyo. Lahat ngayon binabantayan. At gagamit ako ng teknikal, kung nauunawaan ninyo ang teknikal. Makikinig ako sa’yo. ‘Yun lamang ang tanging paraan para labanan ang korapsiyon. Ilegal din ‘yan. Siyempre, ito’y ilegal, kapag naipresenta ko lamang ang ebidensiya sa korte. E ‘pag hindi ko prinesenta ‘yung ebidensiya sa korte, hindi kita ipapakulong, papatayin kita, ‘di tabla rin. Mahirap kasi ‘yung ganun.


Perhaps even terrorists. That is our problem. The coming serious problem of the country, terrorism. We have to beef up the police - I need about 3,000 men more. There are problems of the country that confront us eyeball to eyeball. I cannot move. I have to bide my time because I need equipment. The things that I saw which is not here, which I cannot discuss with you, but which I can discuss with the military and the police.


Siguro pati terorista. Yan ang ating problema. Ang susunod na malalang problema ng bansa, terorismo. Kailangan nating paigtingin ang pulis- Kailangan ko ng humigit kumulang 3,000 dagdag na tauhan. May mga problema ang bansa na kumukompronta sa atin mata sa mata. Hindi ako makagalaw. Kailangan kong hintayin ang aking oras dahil kailangan ko ng kagamitan. Ang mga bagay na nakikita ko na wala dito, na hindi ko masasabi sa inyo, na masasabi ko sa militar at pulis.


Now is the time - I am sure that this is the time for, you know, landing softly. Those among you who live with the extra frills, your salary is only your per diem because of extra. Well, this time, we have to learn how to live frugally and toned down. We are used to buying cars for everybody in the family. Well, I’m sorry. Do not do that because I will - the lifestyle checks would be all the year round. And I would know from your garage, when I inspect, how many is your cars.


Panahon na – sigurado ako na ito ang panahon para, alam niyo na, ang paglapag ng dahan-dahan. Kayong nabubuhay diyan na may ekstrang luho, ang sweldo mo per diem mo lang ‘yan kasi meron kang kinikita. Buweno, sa panahong ito, kailangan nating matuto kung paano mabuhay ng tipid at katamtaman. Nasanay tayong bumili ng mga kotse para sa lahat sa loob ng pamilya. Buweno, paumanhin. Huwag ninyong gawin ito dahil ako’y - ang lifestyle checks ay magiging sa loob ng isang taon. At malalaman ko sa mga garahe ninyo, kapag ininspeksiyon ko, kung ilan ang kotse mo.


This is it. I’m sorry I have to say this in public, in front. But before I forget, I’d like to congratulate and my salute to the Philippine Air Force on their 69th Anniversary. I have seen you in action. I have been a mayor for 23 years. We did a lot of things together. Others have already retired, while some of them are still there. Anyway those… those of you who have observed me close, you will understand me. These are the things I cannot really swallow. And there are things which I cannot swallow until now but I cannot move because I’m looking for the right timing.


Ganun.  Paumanhin kailangan kong sabihin ito sa publiko, harap-harapan.  Pero bago ko makalimutan, gusto kong batiin at ang aking saludo sa Philippine Air Force sa kanilang 69th anibersaryo. Nakita ko ang inyong paggawa.  Ako’y naging mayor ng 23 taon. Gumawa tayo ng maraming bagay ng sabay-sabay. ‘Yung iba nag-retiro na, ‘yung iba nandiyan pa. Sabagay kayong, yung mga nakaobserba sa akin, maintindihan na ninyo ako. Ito ang mga bagay na hindi ko malulunok. At may mga bagay na hindi ko malululon hanggang ngayon pero hindi ako makagalaw dahil nanghihingi lang ako ng pagkakataon.


So we need all of these, more than at any other time, this what I will announce that you need to help the country. I am sure that the security forces, you will have all the things that you need. I will see to that. Everything is needed. We will acquire more helicopters and night vision capability. It’s the one that hampers. If I have that then we can improve our performance.


So lahat ito kasi kailangan natin, higit sa anumang oras, ganun din ang iaanunsiyo ko na kailangan ninyong tumulong sa bayan. Sigurado ako na kayong mga puwersang pangseguridad, magkakaroon kayo ng mga bagay na kakailanganin ninyo. Sisiguruhin ko ito. Lahat kailangan. Bibili tayo ng dagdag na helicopters at may kakayahang makabanaag sa dilim. ‘Yan ang sagabal e. Kung magkakaroon ako niyan mapapaigting natin ang ating mga kilos.


Good that we are talking to the Communist Party of the Philippines. It’s doing well and we hope to have a firm agreement by the end of the year if Sison would come home. I am ready to give him a safe conduct pass. And the Tiamzon spouses and Jalandoni. I am not ready to release everybody. Only after the success of the talks, if there’s one coming our way before releasing them, now we can grant amnesty but they have to lay down their arms.


Maiigi na kinausap natin ang Communist Party of the Philippines. Ito’y bumubuti at umaasa tayo na magkaroon ng solidong kasunduan sa pagtatapos ng taon kung si Sison ay babalik. Handa ko siyang bigyan ng safe condut pass. At ‘yung mag-asawang Tiamzon pati si Jalandoni. Hindi ako handa para pakawalan ang lahat. Lamang pagkatapos matagumpay na pag-uusap, kung may isang lulutang bago ko sila pakawalan, ngayon ay maibibigay natin ang amnestiya pero kailangan nilang isuko ang kanilang mga armas.


In Mindanao, we have so many protracted wars there. I am talking to the MILF, I’ve been communicating with Nur. Maybe, we’ll go to Jolo and talk to him before we formally agree to talk officially. I have my team already. I would not mention them now but they are ready in the government side. Abu Sayyaf, I said, there will always be a time for reckoning and it will come. You should just wait.


Sa Mindanao, may malaganap na giyera doon. Makikipagdayalogo ako sa MILF, nakikipag-usap ako kay Nur. Marahil, tutungo tayo sa Jolo at kakausapin siya bago tayo pormal na magkasundong mag-usap ng opisyal. Meron na akong grupo. Hindi ko sila babanggitin sa ngayon pero sila’y handa sa panig ng gobyerno. Abu Sayyaf, sinabi ko, may oras lagi sa pagsusulit at ito’y darating. Hintay lang kayo.


On the West Philippine Sea, we remain optimistic that the judgment will be in our favor and if it’s not then we will accept it as part of a country who honors international commitments that is by the UNCLOS. When if it’s favorable to us, let’s talk. We are not prepared to go to war. War is a dirty word now, but we will proceed accordingly after we shall have the copy of the arbitral judgment. We will always decide for the greater interest of our country. In the meantime, we’re just hopeful for that.


Sa West Philippine Sea, nanatili tayong positibo sa pabor na desisyon para sa atin at kung hindi man tatanggapin nating parte ito ng isang bansang gumagalang sa kasunduang internasyonal sa pamamagitan ng UNCLOS. Kapag ito’y pabor sa atin, tayo’y mag-uusap. Hindi tayo handang makipaggiyera. Ang giyera ay maduming salita sa ngayon, pero magpapatuloy tayo ng naaayon pagkatapos nating kumuha ng kopya ng arbitral judgment. Tayo’y palagiang magdededisyon para sa malawakang interes ng bansa. Pansamantala, tayo’y umaasa para diyan.


So again, I repeat: The drive against crime, criminality and drugs will continue. Including the - do not so much focus on… I’m reminding the police, focus only on ‘the drugs. Do not forget the —Anyway, everybody has shifted. These kidnap for ransom, murder for hire, do not let them slip away. Others have shifted already because drugs are cheap, can easily be hidden and an instant money.


Kaya inuulit ko: Ang pagkilos laban sa krimen, kriminalidad at droga ay magpapatuloy. Pati ‘yung mga – huwag masyadong pagtutuunan ang… Pinaalalahanan ko ang pulis, pagtuunan ‘yung mga droga lang. Huwag kalimutan ang - Sabagay, naglipatan na lahat e. Itong kidnap for ransom, murder for hire, ‘wag ninyong palusutin ‘yan. Pero ‘yung iba nag-shift na lahat dahil mura, madali itago at pera kaagad.


I said, I gave everybody, every general I think of the Armed Forces of the Philippines, they have the copy of Ioan Grillo. He’s the guy who wrote about the sad state of South America and those countries who’ve fallen to narcopolitics. If not interdicted, these drugs, especially Retired General Vicente Loot of Class ’82, he is a PMA perhaps. He’s now the mayor of a municipality. He’s a Narcopolitics. And, a host of other cities which are not validated by – I prefer those which are already validated. The ones in other place, I really investigated. I went there and asked.


Sinabi ko, binigyan ko ang bawat isa, bawat heneral wari ko ng Armed Forces of the Philippines, meron silang kopya ‘yung kay Ioan Grillo. Siya ang lalaking sumulat tungkol sa nakakalungkot na estado ng South America at ang mga bansang nahulog sa narcopolitics. Kung hindi masupil, ang drogang ito, lalung-lalo na si Retired General Vicente Loot of Class ’82, PMA siguro ‘to. Siya ngayon ay mayor ng isang munisipalidad. Narcopolitics ‘yan. At, isang pulutong ng mga siyudad na hindi nabeberepika ng - gusto ko kasi ‘yung maberepika talaga. Itong sa ibang lugar, nagtatanong talaga ako. Pumunta ako dun at nag-imbestiga.


I hope that we would have a brighter tomorrow of children safe from being harmed. These criminals, everywhere, Pandancan, Sta. Ana, Tondo, the criminals have hijacked. They have taken over the public streets and public places. Our children can no longer go around. And every time when taking the bus, our children who are not – who are not rich though, with hands that are sweating and they are under stress because of “holdup.”


Umaasa ako na magkakaroon ng maliwanag na bukas ang mga bata malayo sa anumang disgrasya. Itong mga kriminal, maski saan, Pandancan, Sta. Ana, Tondo, nakontrol na ng mga kriminal. Nakuha nila ang mga pampublikong lansangan at pampublikong mga lugar. Ang ating mga anak, hindi na sila makapasyal. At tuwing sasakay ng bus, ‘yung mga anak natin na hindi naman - hindi naman lahat mayaman e, nagpapawis na ‘yung kamay at sila’y tensiyonado  dahil “holdup.”


We have to remove that fear. We have to remove that fear. Let us transfer that fear in the hearts of the criminals. So to the criminals, never take a bus. You might be hold upped by the police. To the kidnappers, never kidnap because you will be caught by tactical team of the Air Force, you might be the one to be kidnapped, asked of a ransom, you’re penniless. If I am the Air Force, I will abduct you because you have already abducted a lot, then I will say “where’s is your money?” “Nothing sir , I’ve already spent it in a cockfight.” O really, ‘then I will kill you. Don’t allow yourself to be kidnapped if you have no money because you’re a kidnapper, then if you’re kidnapped you can’t give anything, then you’re also doomed.


Kailangan nating tanggalin ang takot na ito. Ililipat natin ang takot na ito sa puso ng mga kriminal. Kaya kayong mga kriminal, huwag kayong magpasakay-sakay lang ng bus. Baka hold up-in kayo ng pulis. Kayong mga kidnappers, huwag kayong mangidnap kasi maabutan kayo ng tactical team ng Air Force, baka kayo ang ma-kidnap, na ngayon hihingian kayo ng pera, wala kang pera. Kung ako ang Air Force, ki-kidnapin kita dahil marami ka nang kinidnap, tapos sabihin mo “saan pera mo?” “Wala sir e, kasi nagastos na sa sabungan.” O, ‘di papatayin kita. Wala ka pa lang pera e. Kaya ‘wag ka magpa-kidnap, kidnap kung wala kang pera kasi kidnapper ka, tapos kung ikaw ang ma-kidnap wala kang maibigay, tapos ka rin.


That’s life, isn’t it? It’s retribution. If the courts cannot give it, somebody will - God.


Ganun lang ang buhay ‘di ba? Ito’y ganti. Kung hindi maibibigay ng korte ito, may ibang gagawa nito – ang Diyos.
